Cette étude vise à consolider le droit international africain en examinant les mécanismes de protection des droits de l’homme au-delà de la Cour africaine. Elle aborde la question de l’autonomie et de la spécificité de ce droit, en réaction aux perspectives négativistes. La méthodologie repose sur une analyse doctrinale approfondie du régionalisme africain, ses critères systémiques et normatifs, et l’identification des structures régionales et sous-régionales. Les résultats soulignent l’émergence d’un système juridique africain distinct, participant activement à l’élaboration des normes internationales et renforçant la protection des droits fondamentaux sur le continent.
This study aims to consolidate African international law by examining human rights protection mechanisms beyond the African Court. It addresses the autonomy and specificity of this law, countering negative perspectives. The methodology relies on an in-depth doctrinal analysis of African regionalism, its systemic and normative criteria, and the identification of regional and sub-regional structures. The findings highlight the emergence of a distinct African legal system, actively participating in the development of international norms and strengthening fundamental rights protection on the continent.
