Cette étude analyse les limites de l’application du droit pénal international dans la région des Grands Lacs africains, suite à l’explosion de violence des années 90 et au génocide rwandais. Elle examine le contexte politique international de l’institutionnalisation de la justice pénale internationale, notamment le TPIR et la CPI, et les intérêts des acteurs nationaux et internationaux. L’objectif est de questionner le rôle de ces juridictions face à la violence endémique, en dégageant trois modèles d’intervention : collaboration, recours à la justice internationale, et nationalisation du droit pénal international.
This study analyzes the limitations of international criminal law application in the African Great Lakes region, following the violence explosion of the 1990s and the Rwandan genocide. It examines the international political context of international criminal justice institutionalization, notably the ICTR and ICC, and the interests of national and international actors. The aim is to question the role of these jurisdictions in addressing endemic violence, identifying three intervention models: collaboration, recourse to international justice, and nationalization of international criminal law.
