Droits non-dérogeables africains et urgence sanitaire Covid-19

Cet article analyse la non-dérogeabilité des droits de la Charte africaine des droits de l’homme et des peuples face à l’urgence sanitaire de la Covid-19. Il constate que le standard élevé de protection africain est devenu incompatible avec la nécessité d’endiguer la pandémie. L’étude examine les déclarations d’état d’urgence et les mesures coercitives adoptées par plusieurs États africains, évaluant leur impact sur les droits garantis et leur justiciabilité. Elle révèle que ces mesures violent la Charte, rendant certains droits dérisoires, et propose l’adoption d’une convention régionale pour renforcer la sécurité juridique future.

This article analyzes the non-derogable nature of rights under the African Charter on Human and Peoples’ Rights in the context of the Covid-19 health emergency. It notes that Africa’s high standard of protection became incompatible with the need to contain the pandemic. The study examines the declarations of states of emergency and coercive measures adopted by several African states, assessing their impact on guaranteed rights and their justiciability. It reveals that these measures violate the Charter, rendering some rights illusory, and proposes the adoption of a regional convention to strengthen future legal certainty.
