Cet article examine la pratique de l’État congolais concernant le regroupement des exploitants miniers artisanaux en coopératives, questionnant son ingérence dans la liberté d’association. Il analyse la conformité de cette obligation étatique avec le droit minier national et les instruments internationaux des droits de l’homme ratifiés par la RDC. L’étude confronte les dispositions légales et la jurisprudence pour déterminer si cette exigence respecte les principes fondamentaux. Elle révèle comment une simple faculté est devenue une contrainte, offrant une contribution essentielle aux débats sur la révision du Code minier congolais.
This article examines the Congolese state’s practice regarding the grouping of artisanal miners into cooperatives, questioning its interference with freedom of association. It analyzes the compliance of this state obligation with national mining law and international human rights instruments ratified by the DRC. The study compares legal provisions and jurisprudence to determine if this requirement respects fundamental principles. It reveals how a mere option became a constraint, providing an essential contribution to discussions on revising the Congolese Mining Code.
